Man Once Deported Now Charged with OUI

A man confesses to drinking beer while driving in Marlborough.

A Guatemalan citizen who had been previously deported was charged with operating under the influence of liquor in Marlborough over the weekend.

"He told me he had 5 beers within the last hour and a half," reported Marlborough Police Officer Rafael Faria of a man who was pulled over after 1 a.m. on Boston Post Road East.

Police pulled over a man later identified as Walter Isales, 32, of 62 Lowell Street Apt. 2 in Waltham after the vehicle he was driving crossed over the center line several times, according to court documents. Isales has an I.C.E. Detainer out on him and previously was reported and returned to the country, according to court documents.

"Upon approaching the vehicle, I could immediately smell a strong odor of an alcoholic beverage emanating from the vehicle. I also observed that the driver had bloodshot eyes, and slurred speech," wrote Faria in his report which stated that Isales produced a Guatemalan passport and did not have a driver's license.

Upon searching the car, police found a cold, half-full can of beer within Isales' reach, according to court documents.

Isales failed all three standard sobriety tests and then registered a .10 on a breathalyzer at the police station, according to the police report.

"He confessed to be drinking it while driving," wrote Faria in his report.

Isales was charged with operating under the influence of liquor, markes lanes violation, revoked insurance, uninsured motor vehicle, unlicensed operation of a motor vehicle possessing an open container of alcohol in a motor vehicle and negligent operation of a motor vehicle. He was released on $1,000 bail.
