Man Arrested on OUI Wanted by Immigration

A man who failed three field sobriety tests is also wanted by immigration officials.

Police arrested a man early Sunday morning who registered a blood alcohol content of more than double the legal limit.

Police arrested Gustavo Palencia R. Lopez, 31, of 846 Boston Post Road East at 1:29 a.m. Sunday morning on Boston Post Road East after observing multiple marked lane violations, according to court documents. When police pulled him over, they noticed the odor of alcohol from his breath and he failed three field sobriety tests, according to a police report. When tested, he registered a .18 percent blood alcohol content, over twice the legal limit of .08 percent, according to court documents. Lopez admitted to drinking Saturday night.

He was flagged with an Immigrations and Customs Enforcement (ICE) Detainer that would have allowed police to have detained him if they had come into contact with him even if they had not had specific charges to hold him on.

He was charged with marked lanes violation, operating under the influence of liquor and unlicensed operation of a motor vehicle. He is being held at the Middlesex Jail after failing to post $500 bail.
