Attempted Murder in Marlborough

A man from Honduras has been charged with attempted murder after allegedly smothering a woman.

A fight between a man and woman over the weekend resulted in an attempted murder charge when the man allegedly tried to smother the woman.

"She stated she was strangled," said Marlborough Officer Scott Carey who was told by the woman she was also threatened by the man later identified Ever-Jose Rivera-Espinales, 24, of 22 Mount Pleasant Street Apt. 22. "He told her that he would come back from Honduras to kill her if she made him get deported."

Police placed Rivera-Espinales into custody and took the woman to the police station to talk.

The incident allegedly started Saturday morning when the woman returned to the apartment she shared with Rivera-Espinales. While he was sleeping she looked in his phone and saw a message from a woman, according to court documents, prompting her to wake him up by pouring a bottle of water on him. After he woke up the two began pushing each other, according to the police report, and Rivera-Espinales pushed the woman down onto the bed.

"He then pinned her down on the bed and used his hand and covered her nose and mouth. His hand was able to cut off all air that she was trying to breathe and she stated that she felt like she was going to die," wrote Carey in his report.

The smothering reportedly continued for 40 seconds until the woman scratched Rivera-Espinales and bit the inside of his hand until it bled. He then did it again for another 30 seconds until she could break free, according to court documents.

The woman, who had previously refused medical treatment, was transported to the Marlborough Hospital from the police station after complaining of shoulder pains.

Police brough a translator in to speak to Rivera-Espinales. His account was the same until the time of the pushing, wrote Carey.

"He stated that he did not push her and that he was trying to defend himself," stated Carey in the police report. "He said his hands were bitten while his hands were on his head trying to defend himself."

Rivera-Espinales was booked and cooperative throughout the process, according to police. He was held on $2,000 cash bail. The bail was set at that level because he is from Honduras and was out on bail for a class b possession charge, according to court records.
